This offer is addressed to an unspecified circle of individuals and legal entities (hereinafter referred to as the "Benefactor") - visitors to the website of the PUBLIC ORGANIZATION "ASSOCIATION OF BUHURTSCH IN UKRAINE", on the Internet: https://www.buhurtsich.com (hereinafter - the Site), and is an official and public proposal of the PUBLIC ORGANIZATION "ASSOCIATION OF BOUGHT SPORTS IN UKRAINE" (EDRPOU code 44472307), in the person of the Chairman of the Board KARA OLEKSANDR SERHIYOVYCH, acting on the basis of the Statute, to enter into an agreement on a charitable donation (hereinafter - the Agreement), the subject and essential conditions of which are listed below:

1. Terms and definitions:

Public Offer - a valid offer of the Organization, posted on the Site, to provide a charitable donation, addressed to an unlimited number of persons, including the Benefactor.

Acceptance - full and unconditional acceptance of the Public Offer by taking actions to make a money transfer using the payment forms and means posted on the Site, as well as by transferring funds to the Organization's current account through bank institutions. The moment of Acceptance is the date of money transfer and/or crediting of funds to the Organization's bank account.

Charitable donation is a free transfer of funds by the Benefactor into the ownership of the Organization in order to achieve certain, pre-arranged activity goals, in accordance with the Agreement and the Law of Ukraine "On Public Associations".

 

2. Subject of the contract:

The subject of this contract is the free and voluntary transfer of funds by the Benefactor into the ownership of the Organization by making voluntary donations for the implementation of the Organization's statutory activities.

The benefactor independently determines the size of the charitable donation.

The subject of this Agreement is not directly or indirectly obtaining profit for any of the parties to the Agreement.

 

3. Acceptance of the Offer means that the Benefactor agrees with all its provisions, he is familiar with the Charter of the Organization, which is posted in electronic form on the Organization's Website, he is fully aware of and agrees with the subject of the Agreement, for the purpose of public collection of donations and with the right of the Organization to use part Charitable donation of the Benefactor for the administrative expenses of the Organization, in an amount not greater than that provided for by the legislation of Ukraine.

 

4. Benefactor and the Organization, guided by Art. 207, Part 2 of Art. 639, Art. 641, 642 of the Civil Code of Ukraine, agree that from the moment of Acceptance, the Agreement is considered concluded in writing. At the same time, the Parties agree that the parties' failure to comply with the written form of the transaction does not mean its invalidity.

 

5. Rights and obligations of the Organization:

5.1. The organization has the right to:

– Receive Charitable Donations and use them in accordance with the subjects and conditions of this Agreement;

- Without agreement with the Benefactor, change the direction of using the donation within the scope of the Organization's statutory activities;

- Use a part of the Charitable Donation for administrative expenses of the Organization without the consent of the Benefactor, in an amount not greater than that provided for by the legislation of Ukraine.
5.2. The organization is obliged to:

- If the donation is used contrary to the purposes of this Agreement, return the funds to the Benefactor upon his written request.

 

6. Benefactor's rights:

- Monitor the intended use of charitable donations;

 

7. Place of public fundraising:

Public collection of donations is carried out on the territory of any country in the world. The direct activity of the Organization related to the public collection of donations under the Agreement is carried out at the location of the Organization.

 

8. Deadline for fundraising:

The public collection of donations continues until the moment of liquidation of the Organization, unless another term is determined by the Organization.

 

9. Procedure for using charitable donations:

Charitable donations collected under the Agreement are used in accordance with the goals of the Organization. The organization disposes of Charitable donations at its own discretion. Charitable donations received by the Organization can be returned to the Benefactor only in cases provided for by the legislation of Ukraine. The responsibility of the parties for the violation of this Agreement or the procedure for the use of Charitable Donations is provided for by the requirements of the current legislation of Ukraine.

 

10. The benefactor or persons authorized by him have the right to control the intended use of the charitable donation.

 

11. The procedure for general access to the financial reports of the Organization:

Access to the Organization's financial reports is provided by the Benefactor upon his written request.

Other information is presented by the Organization in the manner and within the time limits stipulated by the legislation of Ukraine.

 

12. All expenses for the payment of sums (commissions) related to the transfer and crediting of the donation are borne by the Benefactor.

 

13. The benefactor, by executing the Acceptance, confirms that he is familiar with and agrees with the terms of Appendix No. 1 to this Agreement regarding the collection and processing of personal data.

14. The Benefactor agrees that after entering information about himself when making a Charitable donation, subscribing to the Organization's news or registering on the Site, the Organization may send letters and messages, including those of an advertising nature, to the Benefactor's email address or contact phone number, and in addition in addition, the Organization has the right, without the consent of the Benefactor, to publish on the Site or in any mass media the surname, first name and patronymic or name of the Benefactor as a Benefactor of the Organization. At the same time, the Organization undertakes not to transfer the e-mail address and other information about benefactors to third parties, except in the cases stipulated by the current legislation of Ukraine.

for the processing of personal data

 

By way of Acceptance of a public offer to provide a charitable donation, which is posted on the website of the PUBLIC ORGANIZATION "BUHURTSHI SPORTS ASSOCIATION IN UKRAINE", on the Internet: https://www.buhurtsich.com, in accordance with the Law of Ukraine "On Protection of Personal Data" dated June 1 2010, No. 2297-VI, I give my consent to the NGO "BOUGHT SPORTS ASSOCIATION IN UKRAINE" (hereinafter - the Organization) to process and use my personal data in accordance with the established Procedure for the purpose of implementing the Organization's statutory activities, involving people in activities in accordance with the Organization's charter and the legislation of Ukraine in to the extent necessary for the implementation of the stated purpose of personal data processing.

In addition, I agree that my personal data may be transferred / disseminated / disclosed (including for their further processing and use) in connection with the implementation of competence in the field of activity between me and the Organization to third parties.

In addition, I agree that access to my personal data may be provided to third parties at their request, provided that the specified persons undertake to ensure the fulfillment of the requirements of the Law of Ukraine "On the Protection of Personal Data", in accordance with the procedure provided for in Art. 16 of the Law "On Personal Data Protection".

When changing my personal data, I undertake to provide as soon as possible to the NGO "BOUGHT SPORTS ASSOCIATION IN UKRAINE" detailed information and to submit the originals of relevant documents for entering my new personal data into the partners' personal data base.

By Acceptance of the public offer to provide a charitable donation, posted on the website of the NGO "BUHURT SPORTS ASSOCIATION IN UKRAINE" on the Internet: https://www.buhurtsich.com, I confirm that I have received a notification about the inclusion of my personal data in the personal database from for the purpose of implementing the Organization's statutory activities, involving individuals in activities in accordance with the Organization's charter and the legislation of Ukraine, as well as information about the rights defined by the Law of Ukraine "On the Protection of Personal Data".
